Age Discrimination Homework

Age discrimination is when an unfair recruitment, promotions or granting of privileges based on the age of the recipient. Over the past years this has grown and developed into an al more serious issue and today many are affected by Age discrimination.
A recent example of Age discrimination would be the case of Mr. Barlow. This was a peculiar example as the laws which where to protect him didn’t. According to the ADEA (Age Discrimination in Employment Act) only forbids age discrimination against 40 and older recipients. Age discrimination does not protect workers under forty years old according to the ADEA but on the other hand there are other laws to protect younger workers.
In this case Mr. Barlow has been a victim of Age discrimination because he received about a thousand job rejections, which clearly states the work he applied for discriminated him against his age because having so many rejections logically thinking points to his age.
Age discrimination laws should be tightened as examples like Mr. Barlow across the globe suffer from Age discrimination and jobs should be open to the whole public not just only the younger ones. In our economy today work can be extremely hard to find because of the distress of the population of the world. Older workers also need to pay their bills; pay for food, the loan and more but are unable due to Age discrimination and letting the younger workers get the jobs. When they do get a job they are immediately put under pressure of being fired if work is not efficient. The jobs they do receive aren’t always the best paid and still cause older workers and their families to suffer from a lower income.
On the other hand it is hard to reject an older worker above the age of forty because the worker might suspect Age discrimination but what the company intended to do was to reject him as another more experienced and fresh person seemed for satisfying for the jobs role.
Companies have rights to fire older people above forty years of age. As the worker might not be producing enough effort to his working causing delays in the company, younger workers might at first be looking at lower wages so companies can spare money from hiring younger workers. An older worker suggests they might not be staying in the position he is in for long while a younger worker suggest a longer stay. It also seems that clients tend to find younger workers more efficient then older workers but older workers more knowledgeable and intellect.
In my opinion the laws to Age discrimination should be tightened as more and more people suffer from Age discrimination. Although there are some exceptions for companies where they should be allowed to reject a recipient for own moral reasons such as they have another worker more experienced in the business they are in and hire them as they are more suitable for the job but on the other hand the recipient could suspect this decision as an Age discrimination while the company had no intention to discriminate him or his age.

    This is a really detailed piece of work and really showcases you current progress within business studies! What I would like you to remember is to show more balance. Early on you say the gentleman is clearly a victim of age discrimination. However you do not consider other possibilities. Could he just not be suitable? Is he over qualified an therefore employers think he may not stick the job out?

    Also the question asked why age discrimination occurs despite the law. You didn't really answer this aspect and you need to watch for this in your exam.

    Very good detail, especially on the Age discrimination act, though perhaps refer back to Mr. Barlow in the summary, to relate it more thoroughly, by explaining how his case was fair/unfair, and if the employer was breaching the legislation or not.
